A man who drove when more than three times over the legal alcohol limit has been told he must do 220 hours unpaid work.

Tomas Vainoras was arrested by police who saw him driving in a “sudden, jerky manner” in Spalding town centre on November 17 and was later found to have 112 microgrammes of alcohol in 100 millilitres of breath, the legal limit being 35 microgrammes.

Vainoras (32), of Stonegate, Spalding, pleaded guilty to driving when above the alcohol level limit before Spalding magistrates last Thursday when he was banned for 26 months.

Marie Stace, prosecuting, said police saw Vainoras driving his car out of Westlode Street car park towards the town centre, before coming to an “abrupt halt” at traffic lights on Pinchbeck Road.

“A police officer followed the vehicle as it moved across both sides of the road, changing direction in a sudden, jerky manner,” Mrs Stace said.

She added that Vainoras was stopped on Swan Street and gave a positive roadside test after police smelt alcohol on his breath.

Mark Hudson, mitigating, acknowledged the high reading but said Vainoras had argued with his girlfriend and went out to “calm down” by having a drink.

“Vainoras got into his car and drove when he shouldn’t have,” Mr Hudson said.

Presiding magistrate Jillian Spencer said: “This offence is so serious that we’re going to impose a 12 month community order, with a requirement to do 220 hours unpaid work.”

Vainoras was told to pay £85 costs and a £60 victim surcharge.
