Spalding community police inspector Jim Tyner is asking MPs to change the law so street drinkers can be handed £100 on the spot fines.
The inspector sent a written submission to Parliament pleading for new powers so police can give fines to drinkers the first time they are caught rather than play “cat and mouse”.
He tells MPs the current law allows police to approach drinkers in Designated Public Places Order (DPPO) areas and require them to stop drinking alcohol and confiscate their alcohol.
But they can only give out a Penalty Notice for Disorder (PND) when the drinker refuses to comply.
Insp Tyner continues: “The current legislation does not allow for the feelings amongst members of the public that groups drinking in the street are considered anti-social in their own right.
“Invariably persons found drinking surrender their alcohol upon request so there is no power to issue a PND.
“A game of ‘cat and mouse’ then ensues when persons simply go and obtain more alcohol and the procedure starts all over again.
“The ability to use PNDs in the first instance would be an important introduction to the ‘toolkit’ for tackling anti-social behaviour.”
Insp Tyner tweeted a link on Friday to his submission to Parliament for changes to the street drink law, ending with the words “fingers crossed”.
The inspector revealed last week that he was “working behind the scenes” with South Holland and The Deepings MP John Hayes and district councillors to make sure the new law on street drinking “meets our needs”.
