Driver didn’t know he was disqualified

A driver who didn’t know he was disqualified was arrested by police on the A16 at Crowland.

Ryszard Gordienko (53) was stopped because the police national computer (PNC) showed he had no MOT for his Vauxhall on August 1.

Jim Clare, prosecuting, said a further check with the PNC then revealed Gordienko was banned at Leicester Magistrates’ Court on February 26 and it ran until August 25.

He said the effect of the ban would also mean the insurance he had taken out was not valid.

Gordienko, of Alexandra Road, Peterborough, pleaded guilty to driving while disqualified, without insurance and without an MOT.

Spalding magistrates gave him an absolute discharge for driving while banned, no separate penalty for the insurance offence and a fine of £25 for the MOT offence.

He must also pay £85 costs and a £20 victim surcharge.

Solicitor Andrew Golsborough said Gordienko was not in court when he was banned, but “accepts that under law driving while disqualified is an absolute offence.”

He said: “Not knowing he was disqualified at the time, he did obtain insurance but, of course, that’s nul and void.”

Mr Goldsborough said the MOT ran out two days before Gordienko was stopped.
