Drove into the back of a car

A woman veterinary nurse was hurt on her way home to Spalding when another car drove into the back of hers.

She was driving in a line of traffic on the A16 at Cowbit on November 12 when she spotted in her rear view mirror a car travelling at speed towards her vehicle, Spalding magistrates heard.

Rebecca Ritson, prosecuting, said the impact spun the woman’s car around 360 degrees and the silver Audi that hit her – driven by Viktoras Jackunas – ended up sideways on in a ditch.

Miss Ritson said the veterinary nurse could see Jackunas sitting in his car smoking a cigarette and he “appeared angry” when police were called.

The woman did not go to hospital, but had injuries to her neck, back, forearm and hip.

Her car was also badly damaged.

Miss Ritson said Jackunas provided a positive roadside breath test, but failed to give an evidential test at the police station.

Jackunas was charged only with failing to provide a specimen for analysis.

He entered a not guilty plea at a hearing in November, but changed his plea to guilty on Thursday when he was banned from driving for 12 months, fined £125 and ordered to pay £100 costs with a £20 victim surcharge.

Jackunas (51), of Myrtle Avenue, Peterborough, can cut three months off the ban if he completes a rehabilitation course.

Solicitor Mike Alexander, mitigating, said Jackunas had lung problems but he had managed to give the roadside test and, therefore, should have been able to give the test at the police station.

A police officer was telling him to “blow” but an interpreter translated that as “breathe” and Jackunas was breathing into the machine rather than blowing.

He said Jackunas did admit having “a couple of beers that evening”.

Mr Alexander asked magistrates solely to take into account the evidence given in relation to the failure to supply a breath tests because Jackunas had only been charged with that and “not careless driving or any other road traffic offences”.
